Writ of certiorari was granted by the Supreme Court on March 4^th, 1968 and the case was argued on November 12^th, 1968. There was also one amicus curiae brief submitted with the case, a brief by Roy Lucas and Charles Morgan, Jr. on behalf of National Student Association. In it, they begged the court to reverse the lower courts’ decisions and uphold a student’s right to free speech at school.
On November 12^th, 1968, Dan Johnston argued the case for the Tinkers and Allan A. Herick argued the case for the Des Moines Independent Community School District. Earl Warren was the chief justice at the time.
